Abstract

The Texas Legislature passed S.B. 1660 regarding agreed orders in 1995.

The House Research Organization summarized the bill as follows:

SB 1660 would amend the Water Code and various sections of the Health and Safety Code to provide that TNRCC would not be required to make findings of fact or conclusions of law, other than an uncontested finding that TNRCC has jurisdiction, in an agreed order compromising or settling an alleged violation.

An agreed order could include a reservation that: the order is not a violation; the occurrence of the violation is in dispute; or the order is not intended to become a part of the party's or a facility's compliance history.

An agreed administrative order issued by TNRCC could not be admissible against a party to that order in a civil proceeding, unless the proceeding was brought by the attorney general's office to enforce the terms of the order or to pursue statutory violations.
