Abstract

Numerous bills were filed beginning in 1973 to create an agency to enforce employment discrimination law. Finally in 1983, the Legislature enacted legislation creating the Texas Commission on Human Rights, which was placed in the Texas civil statutes as art. 5221k.

In 1989, the Human Rights Commission faced its first sunset review.

All state agencies undergo sunset review, usually every twelve years. "Sunset review" is the process of evaluating state agencies and determining whether they should be continued or abolished. The process starts with the Sunset Advisory Commission and ends with the enactment of legislation by the Legislature.

Several amendments to the act were adopted and the agency was continued. The term "handicap" was replaced by "disability." Several changes to the definition were also recommended in order to conform the definition to the Federal Rehabilitation Act. During the legislative proceedings there was much discussion whether "perceived" disabilities should be covered and whether persons with AIDS or HIV should be excluded.
