Abstract

During the Regular Session of the 75th Texas Legislature, Rep. McCall filed H.B. 40, which would create Chapter 103, Labor Code, regarding civil immunity for employer Job references. That bill failed to pass.

An interim committee studied the issue and made recommendations.

During the 76th Legislature in 1999, Rep. McCall resubmitted his legislation, under the number, H.B. 341. This time the bill was enacted.

The testimony on H.B. 341 indicated that employers were already free from civil liability when they gave true and correct job reference information. The purpose of the bill was to codify and clarify that concept .
