Abstract

In 1971, the Texas Motor Vehicle Commission Code was originally enacted in 1971 and has been amended by the Legislature almost every session. The Code was originally compiled as Art. 4413(36), Vernon’s Annotated Civil Statutes. In 2001, the text of the Code was revised and transferred to Chapter 2301, Occupations Code.

Every 12 years, Texas state agencies undergo and evaluation called sunset. In 1991, the Motor Vehicle Commission went through sunset. H.B. 524 contained the statutory modifications to the agency recommended by the Sunset Advisory Commission and the other modifications to the agency as determined. by the legislature. Modifications proposed by this bill include:

  • change and add definitions used throughout the bill;
  • change the time line for filing a motion for rehearing of a final order or decision of the commission;
  • add requirements that purchasers of new motor vehicles be notified of lemon law provisions;
  • change and add acts that are unlawful for manufacturers, distributors, and convertors to do;
  • change the responsibilities, terms and conditions that manufacturers, distributors, and convertors have to dealers when franchisees are terminated;
  • change the conditions under which a new motor vehicle dealer has to reimburse lienholders, manufacturers, distributors, and convertors for dealer-added items and options if a motor vehicles is repurchased: by a manufacturer, distributor, or convertor;
  • set standard criteria for administrative penalties;
  • adds serious safety hazards to grounds for lemon law ,recovery and reduces the number of required repair attempts required under the lemon law from four to two;
  • authorize payment of up to $250 for incidental damages in lemon law cases;
  • establish a 150 day time line for resolving lemon law complaints;
  • require that a permanent label be affixed to a vehicle repurchased under the lemon law and prohibit the label from being removed; and
  • provide for various other changes recommended by the Sunset Commission.
