Abstract

During the regular Session of the 77th Texas Legislature in 2001, Rep. Goodman introduced H.B. 1051 which added a new Sec. 24.013 to the Uniform Fraudulent Transfer Act in the Texas Business and Code. This new section allowed a court to award costs and attorney’s fee in a UFTA case.

Hearings were held for H.B. 1051 in the house and it passed on second and third readings. However the Senate took no action on the bill.

In 2003, Rep. Goodman re-introduced the bill, under the number H.B. 276. This time the bill received hearings in both the House and the Senate and was passed by both houses. The bill was signed by Gov. Perry and was effective on September 1, 2003.

This report follows all of the proceedings on H.B. 1051 (2001) and H.B. 276 (2003).
